Terms of Service
These terms cover your use of BrainView AI, operated by Brain View IA LLC, including the website at trybrainview.com and the BrainView mobile apps. Creating an account means you accept them.
What BrainView is
Software for running a contracting business: takeoff, estimates, invoicing, job costing, scheduling, crew time and cash. It is a record-keeping and calculation tool. It is not an accountant, not a lawyer, and not a licensed financial adviser.
Read this one. BrainView performs arithmetic on the numbers you enter. You are responsible for checking any estimate, invoice, tax figure or profit calculation before you send it to a customer, pay someone against it, or file anything with it. Confirm your own sales tax rate with your accountant. A wrong number you approved is still a wrong number you sent.
Your account
- Give accurate information and keep your password to yourself.
- You are responsible for what happens under your account and for anyone you invite into your company.
- Tell us promptly if you think someone else has access.
- You must be 18 or older and using BrainView for a business.
Your data belongs to you
Everything you put into BrainView is yours: your customers, jobs, numbers and photos. You grant us only the permission needed to store it, process it and show it back to you and the people you invite. We do not sell it and we do not use your business records to train models. You can export or request deletion at any time.
What you may not do
- Try to reach another company’s data, or probe the service for ways to do so.
- Upload anything unlawful, or anything you do not have the right to upload.
- Resell or white-label BrainView without a written agreement.
- Use it to send unsolicited bulk email. The campaign tools are for your own customers who expect to hear from you, and you are responsible for complying with anti-spam law where you operate.
- Interfere with the service or attempt to overwhelm it.
Availability
We aim to keep BrainView running and to take care with your data, but we do not promise uninterrupted service. Maintenance happens, and providers we depend on occasionally fail. Keep your own copies of anything you cannot afford to lose.
Fees
Where a paid plan applies, the price, billing period and what is included are shown before you subscribe. Subscriptions bought inside the iOS or Android app are billed by Apple or Google under their terms, and cancellations are handled through those stores. Fees already paid are not refundable except where the law requires it.
Ending it
You can stop using BrainView and ask for deletion whenever you like. We may suspend an account that breaches these terms or puts other customers at risk, and we will tell you why where we can.
Liability
BrainView is provided as-is. To the extent the law allows, we are not liable for lost profits, lost business, or for figures you relied on without checking. Where liability cannot be excluded, it is limited to what you paid us in the twelve months before the claim.
Changes
If these terms change materially we will tell you in the app before the change takes effect. Continuing to use BrainView after that means you accept the new version.
